What Is A Counter Attorney Fee?
If the plaintiff is represented by a lawyer and wins the case, the defendant is obliged to pay the plaintiff’s lawyer the amount specified in the Attorney’s Minimum Fee Tariff. In summary, the lawyer of the plaintiff who wins the case will receive an attorney’s fee from the losing party.
HOW IS THE COUNTER-ATTORNEY FEE CALCULATED IF THE AMOUNT OF THE LAWSUIT IS LOW?
If the plaintiff files a lawsuit for damages amounting to 500 TL, will the counter-attorney fee that he/she will be sentenced to when he/she loses the case be 3400 TL (2020 tariff of the Civil Courts of First Instance) or will it be only 500 TL.
Pursuant to Article 13/2 of the Attorneyship Law, the attorney fee awarded cannot exceed the amount accepted or rejected.
In this case, if the lawsuit amounting to 500 TL is filed and partially lost, that is, if 250 TL is accepted, the attorney fee will not exceed 250 TL.
