Rule of goodwill and honesty
A common confusion in practice also makes its mark on this issue
it struck: subjective wishful thinking; that is, objective wishful thinking with Good Will, that is, the rule of honesty, is often confused. In MK 4721, the regulation on them is as follows:
“I. Act honestly / Article 2-Everyone must comply with the rules of honesty when exercising his rights and fulfilling his debts./ The explicit abuse of a right does not protect the order of law.
II. Good faith / Article 3-in cases where the law binds a legal result to good faith, the main thing is the existence of good faith./ However, no one who does not show the due diligence expected of him in accordance with the requirements of the situation can claim good faith”.
