SUBJECT OF THE CASE : Request for appointment of a guardian.
FACTS : 1- While the plaintiff was married to the client’s brother ……………, ……………, they divorced as seen in the attached judgment and the custody of two daughters, one of whom was 3 and the other 2 years old, was given to their mother. The mother took care of the children for a short period of time, about 6 months, and then left the children at the home of the client’s uncle and fled to Antalya.
2- After the divorce case, the client’s brother and the father of the children …………. died in a traffic accident, and the mother went abroad with a tourist she met in Antalya and has not been heard from for a long time.
3- The client has been taking care of the children for the last two years as he is the uncle of the children, however, he has been facing some legal problems as he is not the legal representative of the children. In this respect, it is necessary to appoint a guardian for the children in order to eliminate these problems.
For these reasons, it has become necessary to file this lawsuit.
LEGAL GROUNDS :
EVIDENCE : Divorce decree, population records, witness statements and all kinds of evidence.
CONCLUSION AND REQUEST : According to the reasons and evidence presented above, I request that our request be accepted and the plaintiff, who is their uncle, be appointed as the guardian of …………….. and ………………. due to the death of their father and the fact that their mother is abroad.
