SUBJECT: It is a request for objection to the debt and suspension of the proceedings.
EXPLANATIONS
1- We object to the payment order, which we have been notified on ……………., in due time.
2- Our client does NOT owe ……………………..TL to the company claiming to be the creditor as requested in the payment order. WE EXPLICITLY OBJECT TO THE DEBT. We request a decision to stop the proceedings. The amount and rate of interest requested is also unfair and exorbitant.
3- Moreover, the creditor’s claims and demands are also in need of judgment. There is no credit card used by our client for the amount requested to be refunded. Our client has not signed any credit card agreement or loan agreement with the apparent creditor. Therefore, it is clear that the demand is unfair and in need of judgment.
4- In addition, there is enough movable property to cover the debt at the notification address where the payment order was notified. We submit it for your information to replace the declaration of property.
CONCLUSION and REQUEST: For the reasons explained, we would like to request for your tensip and opinion that the proceedings be suspended and canceled.
