EXPLANATIONS
1) Our client’s father, XXXXX XXXXX, is 86 years old and is unable to manage his assets or follow up on and manage his affairs. Due to the health problems experienced by our client’s father, the company affairs that need to be taken care of are progressing very slowly and with problems. At the beginning of 2017, our client’s father was diagnosed with Alzheimer’s disease. We are submitting the doctor’s report as an attachment.
2) Due to his illness, our client’s father is unable to carry out his duties as chairman of the board of directors of XXXXXX Inc. and even his personal affairs. He has lost the ability to evaluate the causes and consequences of his actions and must be placed under guardianship.
3) Due to his illness, our client’s father is unable to assume legal responsibility. Our client has been handling all of his father’s affairs for approximately one year. It is extremely difficult to continue our client’s father’s company affairs and monitor his personal assets and affairs in this manner. It has become necessary to apply to your court for the appointment of our client as guardian for his father.
EVIDENCE: Population Registry, Hospital Records, Medical Report, Witnesses, and all other legal evidence.
CONCLUSION AND REQUEST: For the reasons briefly explained above and which will be taken into consideration by your court, we respectfully request that you rule on the appointment of our client XXXXX XXXXX as guardian for his father XXXXX XXXXX.
