Execution and Bankruptcy Offense- Violation of the Provisions on the Abandonment of Trade
In terms of the offense of violating the provisions of abandoning the trade, the debtor must be a trader. In addition, this trader is the debtor’s FIRST m.he/she must not have notified the trade registry that he/she has abandoned the trade by not fulfilling the requirement of provision 44, or he/she must have never made a goods notification or made a missing goods notification. However, in the law, only these actions of the debtor trader were not considered sufficient in terms of the occurrence of enforcement offenses, as well as the condition was sought that the creditor would be harmed by these actions of the debtor.
Of course, the creditor’s complaint is important for the prosecution of enforcement offenses, since the crime of violating the provisions of abandoning the trade is a complaint-related offense.
If the court in charge of enforcement offenses is the Executive Criminal Court, the competent court is the court where the debtor’s processing center is located, or the court where the enforcement directorate is connected, where enforcement proceedings are conducted.
