SUBJECT :It consists of our request for the determination of evidence.

EXPLANATIONS :

1-) My client and the other party inherited an immovable property from their fathers in ….. province ….. district …. neighborhood. The immovable property in question was divided as a result of the lawsuit filed by the client in the Cadastral Court and the immovable property belonging to the client was surrounded by fences by the client.

2-) However, although the client surrounded the immovable property with fences, the other party broke and threw these fences and caused material damage to the client. Not content with this, the other party caused erosion of the client’s land by filling large drums with water and pouring the drums at the same time due to the steepness of the client’s immovable (field). This will be proved by the discovery to be made at the scene of the incident and by the witnesses to be heard at the scene of the incident.

        This immovable property, which my client uses for agricultural purposes, has become partially unusable due to the damage caused. The client suffers material and moral damage due to this situation.

        3-) It has become necessary to apply to your court in order to ensure that the damage to the immovable property is determined without delay as a basis for the lawsuit we will file for compensation for the material damage caused by the other party to the immovable property.

LEGAL GROUNDS : 6100 S. K. Art. 316, 400, 401, 402, 403, 404, 405

LEGAL EVIDENCES : Witness list showing the names and addresses of the witnesses and the subjects they will testify, 3 photographs showing the state of the immovable after the damage, expert report and other evidence.
