In the offence of withdrawing without increasing for the purpose of providing benefit, the person who does not participate in the increase or withdraws from the increase in exchange for the promise to provide benefit or benefit to himself or anyone else in the tenders shall be punished. In addition, intermediaries who contribute to this crime by mediating tenders will be punished in accordance with the same law. In order for the offence of withdrawal without increase to benefit to occur, there must be a tender made by the execution Directorate and it is necessary for the execution offences that a benefit or a promise has been made to the defendant not to participate in or withdraw from this tender. The follow-up of the crime depends on the complaint and a complaint must be made by the creditor, debtor or related third parties. The court in charge of these enforcement offences is the Enforcement Criminal Court, and these matters cannot be combined with criminal proceedings in other courts. The competent court in respect of crime is the court to which the execution office where the execution is followed.
