EXPLANATIONS :
The suspect worked at the client’s workplace for a period of time. During this period, he borrowed some money from the client but did not pay these borrowed money. Enforcement proceedings were initiated against the suspect for these monies sent by the client through his bank account. There was a hostility between the client and the suspect due to this reason.
In the correspondence between the phone number …….., which is in the use of the suspect, and the phone number …………., which is in the use of the client, between the dates ../../…. and ../../…., the suspect has insulted the client in the records presented in the annex. Although the client warned the suspect not to write to him and not to disturb him, the suspect continued to write persistently and with the sole intention of disturbing the client. Most of the insults addressed to the client by the suspect have been deleted from whatsapp records. The client has had the chance to take screen shots of only a certain part of these insults.
Due to these actions taken by the suspect, the crime of insult regulated in Article 125 of the Turkish Penal Code and the crime of disturbing the peace and tranquility of persons regulated in Article 123 of the Turkish Penal Code have been committed.
Article 125 of the TPC stipulates that “A person who imputes a concrete act or fact that may offend the honor, honor and dignity of a person (…)[45] or who attacks the honor, honor and dignity of a person by swearing shall be sentenced to imprisonment from three months to two years or to a judicial fine. In order to punish the insult in the absence of the victim, the act must be committed in the presence of at least three people. (2) If the act is committed through an audio, written or video message addressed to the victim, the penalty specified in the paragraph above shall be imposed.” Therefore, insults against my client are considered a crime under the Turkish Penal Code.
When all these issues are carefully examined, we request that a public lawsuit be filed for the punishment of the suspect since his actions constitute a crime according to Article 125 of the Turkish Penal Code.
