It is often observed that real creditors exhibit attitudes and behaviors that prevent them from taking their receivables.

The lawmaker aims to protect the rights of creditors pursuant to the law of follow-up by stipulating imprisonment and judicial fine for debtors‘ actions and behaviors in accordance with Article 331 of the Execution and Bankruptcy Law.
The fact that the debtor has acted in order to harm his creditor is one of the conditions required for the occurrence of the crime. Due to the acts dated more than one year, the liability of the debtor will not arise as the right to complain has been eliminated.
Another requirement is that the creditor should suffer losses. The burden of proving that it has been damaged is in the creditor. The creditor is obliged to prove that he was unable to collect his receivables in the execution proceedings he started against the debtor. In practice, the helpless document obtained from the execution file is used as a proof tool. There are two types of helpless documents, temporary and definitive. Although it is not explicitly stated in the law, it is accepted in the doctrine that the incapacitated document that the law seeks is the definitive incapacitated document.
