What Is A Rent Determination Lawsuit?

A lawsuit to determine the rent amount is filed with the Civil Court of First Instance where the defendant resides or where the contract is performed—that is, where the property is located.

A lawsuit to determine the rent amount may be filed at any time to establish the new rent amount in a renewed lease agreement.

However, the decision to be rendered in such a lawsuit;

If the action to determine the rent was filed at least 30 days before the start of the new lease term,

If the tenant was given written notice at least 30 days before the start of the new lease term that the rent would be increased,

If the lease agreement contains a provision stating that the rent will be increased during the new lease term, it shall apply from the beginning of the new lease term.
