SUBJECT: This is our petition requesting an increase in alimony.
EXPLANATIONS
1- The defendant and our client were divorced by the Istanbul Anatolia Family Court on XX/XX/XXXX, Case No. XXXX/XXX and Decision No. XXXX/XXX. The case was appealed to the Court of Appeals and became final on XX.XX.XXXX.
2- In the final decision, our client was awarded monthly alimony of 12,500.00 TL.
3- As a result of the divorce case, custody of the minor children XXXXX and XXXXX was granted to our client, the plaintiff mother. Additionally, the defendant was ordered to pay monthly alimony of 7,500.00 TL for the children.
4- The alimony amounts awarded in this case, which was decided approximately four years ago, are no longer sufficient to meet the needs of our client and her children. During this process, our client has been emotionally drained and lost her job due to the media coverage of her problems with her spouse. The children have started their education. We are submitting the children’s school information and monthly school installment amounts as an attachment to the file.
5- While our client lost his job, the defendant gained more fame due to this divorce case and signed many deals that made his name known in the media, thereby gaining more benefits thanks to his marriage to our client. After the divorce, alimony payments were collected from the defendant through enforcement proceedings, even though he did not even visit his children.
6- When the expenditure information for the joint children, which we have submitted as an attachment to the file, is reviewed, it will become clear how much our client has struggled and that the alimony amount determined in the previous file was significantly low.
7-Increasing the alimony paid to our client from 12,500.00 TL to 25,000.00 TL,
Increasing the alimony paid to the joint child XXXX from 7,500.00 TL to 20,000.00 TL,
Increasing the 7,500.00 TL alimony paid to the joint child XXXXX to 15,000.00 TL, will enable the client and the children to maintain the standard of living they lost due to the divorce case.
8- Considering the improvement in the defendant’s financial situation, the excessive increase in the children’s needs, the addition of items such as education expenses and course expenses arising from the children’s growth to these needs, and the fact that the previously determined amount is too small for our client’s livelihood, it has become necessary to file this lawsuit.
EVIDENCE: Istanbul Anatolia Family Court File No. XXXX/XXX, Economic Status Investigation, Expenditure Documents, Payment Schedule Showing Educational Expenses, Witnesses, Experts, and Other Legal Evidence
CONCLUSION AND REQUEST: For the reasons briefly explained above and those that will be considered by the court ex officio, we request that the monthly alimony of 12,500.00 -TL, and for the monthly child support for the joint child XXXX, which has been determined as 7,500.00 TL, to be increased to 20,000.00 TL after evaluating the education expenses we have submitted in the annex, and for the monthly child support for the joint child XXXX , which was determined to be 7,500.00 TL per month, be increased to 15,000.00 TL per month, taking into account the expense documents we have submitted in the appendix, and that the litigation expenses and attorney’s fees be imposed on the defendant party.
